Golden Retrievers Puppy Sales Contract Preview 

 

As dedicated breeders of Golden Retrievers, our responsibility is to protect our puppies.  Therefore, we have developed our contract to protect the purchaser, breeder, and most of all, the puppy. Under the terms of this contract, the undersigned parties agree to the following conditions regarding the golden retriever puppy described below:

•Deposit: Breeder hereby accepted a non-refundable deposit of $500.00, which has been paid with the execution of the Reservation Agreement and has been applied towards the purchase price of the puppy. It is agreed that said deposit is the Buyers commitment to buy the puppy. Buyer will pay the next payment of $1500.00 concurrently at the execution of this contract which includes puppy selected, and balance at said time, the Buyer will either pay in US dollars, or payment by Zelle which must be processed in full 7-10 days prior to pick up. If the Buyer does not make full payment at the time of pickup of their puppy, buyer forfeits deposit, any money paid, and puppy is released for sale to next customer. . Initial_______ 

 

Breeder Agreements:

·         Both the Sire and Dam are purebred and AKC registered. 

·         The Breeder has exercised every practice known by ethical breeders at this time to produce sound, healthy Golden Retrievers. A 12-month congenital health guarantee is offered on purchased puppy regarding genetic defects.

·         The puppy is in good health at the time of purchase. The puppy has also been loved daily and properly cared for to date. The puppy has received its first set of shots and been dewormed on a schedule.  

·         Immunization records will be furnished at the time of delivery.

·         Our puppies are primarily intended for families who desire a pet, therapy, obedience, and/or working dog.  Occasionally a show prospect is available.

·         As of the signature date of this contract, both Sire and Dam have NOT been affected by cancer, or epilepsy.

·         The Breeder does not assume any liability for any injury or veterinarian expenses to purchased puppy once picked up by the buyer or delivered safely by Breeder to the airport personnel.

Buyer Agreements:

•   •        The buyer agrees to have the puppy examined by a licensed and reputable Veterinarian within 3 business days of taking possession of the puppy to verify the puppy is in good, sound health and to get the next wormer treatment if needed and agrees to keep puppy in arms as to not allow risk of contracting illness in Vet office or public area until fully vaccinated.  If the veterinarian finds the puppy to be at risk due to congenital defect (existing at birth), owner shall notify Breeder and provide a written statement from licensed Veterinarian describing the puppy’s condition and shall return, at Buyer’s expense, the puppy to the breeder within three days of the examination. Examples would be failure of a major organ which sustains life such as heart, lungs, liver, kidneys etc.; these would be considered congenital defects and are warranted for a period of one year from date of birth. If the puppy is in the same condition mentally and physically as when originally purchased, the Breeder will provide a replacement puppy of equal quality, sex and bloodline (which will be determined solely by the breeder) at no charge within 24 months of the animal’s return.  Any shipping fees for a replacement puppy is the sole responsibility of the Buyer.  All veterinary bills are at the buyer’s expense.  This return does not include fleas, mites, ticks, coccidia, giardia, mange, or any other parasites as they are common in dogs and puppies. Bone-joint issues, going blind, becoming deaf, limping, minor physical flaws, allergies, retained baby teeth, improper bite or any other non-life-threatening condition or health problem which may develop after purchase, are not covered as no breeder can guarantee this outcome for 100% of every litter born.   It also does not include indigestion of foreign objects, ingestion of food or chemicals, or physical injury contracted or incurred following Buyer’s receipt of puppy. ·        In the event of the puppy’s death, the Buyer must notify the Breeder within 24 hours. Should death occur, a complete necropsy (not reimbursed by Seller) shall be required to verify the cause of death.  All documentation including lab results must be forwarded to Seller or designee. Accidents (of any type), neglect, abuse or any other illness that could have been prevented by the purchaser will not be covered under this guarantee. Under no circumstances shall Seller be held responsible for any veterinary bills, medications, shipping costs, travel expenses or any other expenses, after purchase. When puppy leaves Seller’s home, it becomes the sole responsibility of the Buyer.          

·        The puppy is sold to the Buyer(s) in the good faith that it will not be bred. The buyer must have the puppy spayed/neutered at or after 18 months of age and you must send proof of spay/neuter to Breeder by email to receive AKC limited registration information to register online. If spayed/neutered before 18 months or if dog is bred, contract is null and void. Initial_____. The puppy is to receive proper veterinary care and vaccinations for the duration of its life. It is required to purchase pet Insurance for the first 2 years, or the contract is null and void. Initial_____.  Puppy should receive the core vaccines Distemper, Adenovirus, Parvovirus, at 16 weeks and rabies as required by state and prevention for heartworms and fleas.

·        Buyer agrees to protect puppy from others and not visit dog parks until fully vaccinated. Puppy will be held in arms and not put on the ground at Vet office as they are most safe on your arms until they are fully vaccinated. Initial_____.  

·         No guarantee on show potential, exact size, ear set, or coat color/type at adulthood. Initial_____.

·        The Buyer agrees to provide high-quality food. Breeder recommends Taste of the Wild Ancient Grains with Smoked flavor Salmon, Purina Pro Plan 30/20 formula or Purina Pro Plan Salmon and Rice puppy formula for large breed until 19-24 months and transition to Purina Pro Plan 30/20 salmon or beef or Purina Pro Plan Salmon for sensitive skin and stomach for large breed.

·        The Buyer agrees NEVER to sell/give/trade/transfer ownership of this puppy to any large commercial breeding establishment, any agent, any wholesaler, or any party not included in the original sales agreement.

·        In the event, at any future time, the Buyer cannot keep this puppy, the Buyer must first notify and get an agreement from the Breeder. This dog, including signed registration and all veterinarian records, can be returned to the Breeder at the Buyer’s expense.  If the Buyer has a good home lined up, the Buyer will notify the Breeder to help screen the new party interested in taking new ownership of the dog.  The Breeder has the first right of refusal. The new home must be a pet home and the puppy/dog must be spayed/neutered.  The guarantee becomes void if breeder is not properly notified before being re-homed.

·        Should an animal purchased under this agreement be returned for any reasons whatsoever, buyer accepts responsibility for, and shall pay, without recourse against the Seller, all transportation expenses, veterinary charges, crate fees, air freight charges, and transport fees to and from the involved airports.

Buyer(s) agrees to release and hold harmless the Breeder and Jennifer Rangel for any and all liability, damages, or injuries, caused either directly or indirectly by this dog to any person, whether actual or legal, or to any property, whether real or personal. Furthermore, Buyer(s) assumes full liability for any damages or injuries, whether actual or legal, or to any property, whether real or personal, after receiving possession of this dog. Buyer(s) further agrees to indemnify or reimburse the Breeder Jennifer Rangel as a result of any costs or expenses incurred as a result of any act of the Buyer(s) causing liability, damages, or injuries as set forth herein.    

  Health Guarantee:

Limitations of Guarantee.   

•   Failure to comply with conditions of this contract shall constitute a “breach of contract” and will result in the dog being permanently returned to the Breeder along with registration papers.  Further, the Buyer will be responsible for all expenses with no expense to the Breeder.

•   The following will also void all guarantees:

Buyer permitting the dog to be underfed or overfed at any time.

Unexplained or untreated trauma (broken bones, related injuries, physical harm, etc.)

Evidence of neglect or abuse

Evidence of strenuous exercise                                                                                         

For purposes of this agreement, a reputable veterinarian is one who is duly licensed by the state in which he practices and maintains an active, full-time private practice of which the care of dogs owned as pets is the most significant element of his practice.

Modification. This agreement may be modified only by a written agreement signed by all parties. There shall be no oral modifications to this agreement.

 I have read, understand, and agree to abide by the terms of the items contained in this contract.  I understand that this document contains the entire agreement of the parties and shall be binding to the parties signing, as well as their heirs, successors, and legal representatives.

Seller assumes no responsibility after said puppy leaves possession, for any change of mind on the owner’s part, such as, but not limited to, landlord’s disapproval, allergy to the animal, disagreement of family, etc.  Breeder does not guarantee adult size, color, conformation, disposition, or potty-training ability of said puppy after date of purchase. AKC registration papers are provided to Buyer, once buyer provides documentation of spay/neuter. If AKC registration papers are lost or misplaced thereafter, Buyer agrees to pay Seller $800 for time and expense involved in requesting duplicate pet registration papers from AKC.  Buyer agrees any legal issues which may arise would be resolved between Buyer and seller without the intervention of the court or attorney as a first option and if a matter can’t be resolved both buyer and breeder agree to accept their losses and walk away. Out-of-state laws are not valid per this purchase agreement. All attorney fees and court costs would be the Buyers responsibility.

 

Buyer and Seller acknowledge and accept this as a legal and binding purchase agreement & health guarantee. Buyer acknowledges full understanding and agrees to the terms of this purchase agreement, conditions of sale, accepts full responsibility for the health and well-being of said puppy.
